This is a legally binding license agreement between Teehan+Lax Inc. (in this license agreement, "we", "us" and words of similar meaning) and you. It governs your use of the TweetMag application ("TweetMag"), including any upgrades to or revisions of TweetMag (unless those upgrades or revisions are accompanied by a new license from us, in which case that new license applies to those upgrades and revisions), and applies to you if you purchase or use TweetMag. If you do not agree with the terms of this license, please do not use TweetMag.
This license incorporates by reference the "Licensed Application End User License Agreement" (the "Apple License") included in Apple's iTunes Store Terms and Conditions, located at http://www.apple.com/legal/itunes/ca/terms.html. The Apple License applies to your use of TweetMag to the same extent as if the entire form of the Apple License was set out in full in this license, subject to the additions and revisions to it included in this license. In the event of any conflict or inconsistency between this license and the Apple License, this license shall apply.
By using TweetMag you acknowledge that TweetMag allows you to access content, data, information or materials ("Content") from third-party External Services (as defined in the Apple License), to optionally share Content with us and also with other users of TweetMag, and to optionally present Content on your device in different ways, and you agree that we have no liability or responsibility to you or any other person for any of the foregoing.
Our collection, use and disclosure of the data collected by TweetMag is subject to our privacy policy, located at http://www.tweetmagapp.com/privacy, and by entering into this license agreement you consent to your collection, use and disclosure of that information in accordance with the privacy policy.
This license shall governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. Any dispute concerning this license or your use of TweetMag shall be heard only before the courts of the Province of Ontario, in the City of Ontario, and by using TweetMag you agree to their jurisdiction.
